These Terms & Conditions apply when you use The Anime Otaku website or purchase products from us online. Please read them before placing an order.

Nothing in these Terms affects your statutory rights as a consumer.

2. Using Our Website

You may use our website for personal, non-commercial purposes and to browse and purchase our products.

You must not:

• use our website for fraudulent, unlawful or malicious purposes;

• attempt to gain unauthorised access to our website, systems or customer accounts;
• introduce viruses, malicious software or other harmful material;
• scrape, reproduce or commercially exploit our website or its content without permission; or
• infringe our intellectual property rights or those of another person.

We may restrict or suspend access where reasonably necessary to protect our website, customers or business.

3. Accounts

You may be able to create an account to make shopping with us easier.

You are responsible for keeping your login details confidential and should notify us promptly if you believe someone has accessed your account without permission.

You are responsible for ensuring that the information you provide to us is accurate and up to date.

4. Products

We take reasonable care to ensure product descriptions, specifications, prices and images are accurate.

Colours and appearance may vary slightly depending on your screen or device. Packaging may also occasionally differ from images shown where manufacturers update their packaging.

Product dimensions and measurements are approximate unless stated otherwise.

Nothing in this section affects your rights where goods are faulty, not as described or otherwise fail to meet the requirements of UK consumer law.

5. Collectibles, Figures & Product Packaging

Many of the products we sell are collectibles, and their packaging may form part of the product.

Minor variations in paintwork, positioning, finish or packaging can occur during manufacturing and do not necessarily indicate that a product is faulty.

Where we identify significant packaging damage before dispatch, we will endeavour to make this clear where reasonably practicable.

All products we sell as new are supplied as new unless clearly stated otherwise on the product page.

6. Availability

All products are subject to availability.

Adding an item to your basket does not reserve it.

Occasionally, an item may become unavailable after you place an order. If we cannot supply a product, we will contact you and refund any amount you have paid for the unavailable item.

7. Prices

Prices are displayed in GBP (£) unless otherwise stated and include VAT where applicable.

Delivery charges and any other applicable charges will be shown before you complete your purchase.

We may change our prices at any time, but price changes will not normally affect orders we have already accepted.

If a product has been listed at an obviously incorrect price due to a genuine error, we may contact you before accepting or fulfilling the order and give you the option to purchase it at the correct price or cancel the order.

8. Placing an Order

When you submit an order, you are offering to purchase the products in your basket.

Receiving an order confirmation does not necessarily mean that we have accepted your order. A contract between you and us is formed when we confirm that your order has been accepted or dispatched, depending on the wording of our order communications.

We may decline or cancel an order where reasonably necessary, including where:

• a product is unavailable;
• payment cannot be authorised;
• there is an obvious pricing or product information error;
• we reasonably suspect fraud or unauthorised activity;
• applicable purchasing restrictions have been breached; or
• we cannot deliver to the address provided.

If we cancel an order after taking payment, we will refund the relevant amount.

9. Payment

We accept the payment methods displayed during checkout.

Payment is generally taken when your order is placed or processed. Your payment provider may carry out additional security or verification checks.

You confirm that you are authorised to use the payment method provided.

10. Delivery

Available delivery options, charges and estimated delivery times will be displayed during checkout.

We aim to deliver within the estimated timeframe provided, but delivery dates are estimates unless we expressly agree otherwise.

If delivery is materially delayed, please contact us. Your statutory rights relating to late or failed delivery remain unaffected.

You are responsible for providing an accurate and complete delivery address.

11. International Orders

Where international delivery is available, orders may be subject to import duties, taxes, customs charges or handling fees imposed by the destination country.

Unless we expressly state that these charges are included at checkout, you will normally be responsible for paying them.

You are also responsible for ensuring that products ordered can lawfully be imported into the destination country.

12. Returns, Cancellations & Refunds

Your rights to cancel an online purchase and return products are explained in our Returns & Refunds Policy.

For most online purchases, consumers have a statutory right to cancel within 14 days of receiving the goods, subject to certain exceptions.  The right to return only exist for UK customers.

Separate rights apply where goods are faulty, damaged, not as described or otherwise do not meet the requirements of the Consumer Rights Act 2015.

Nothing in these Terms or our Returns & Refunds Policy limits those statutory rights.

13. Pre-Orders

Where we offer products for pre-order, any stated release or delivery date is an estimate and may change due to circumstances outside our control, including changes made by manufacturers, distributors or licensors.

If a pre-order is significantly delayed or cancelled, we will contact you where appropriate and explain the options available, including any applicable cancellation or refund rights.

Any specific conditions shown on the pre-order product page will also apply.

14. Promotions & Discount Codes

Promotions and discount codes may be subject to additional conditions displayed when the promotion is offered.

Unless stated otherwise, discount codes:

• cannot be exchanged for cash;
• cannot be applied retrospectively;
• may have an expiry date;
• may exclude particular products or categories; and
• may not be combined with other promotions.

We may withdraw or refuse a promotion where it has been used fraudulently, improperly or contrary to its stated conditions.

15. Intellectual Property

The content of our website, including our branding, logos, website design, text, graphics, photographs and other original content, belongs to The Anime Otaku Ltd or is used by us with permission.

Anime, manga, character, franchise, manufacturer and other third-party names, images, logos and trademarks remain the property of their respective owners.

Nothing on our website grants you ownership of or rights to use our intellectual property or that of third parties except as necessary for normal personal use of the website.

16. Creator Features & Independent Sellers

We may feature independent artists, designers and creators through our website or physical store.

Where products are sold directly by The Anime Otaku, your purchase is from us unless we clearly tell you otherwise. Refund and Returns of these products will be between you and the independent seller.

Where we feature or link to an independent creator but the transaction takes place directly between you and that creator, we will make this clear. The creator's own terms and policies may then apply to your purchase.

17. Our Responsibility to You

We do not exclude or limit our liability where doing so would be unlawful.

This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and your statutory rights relating to products purchased from us.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Our products and website are provided for private consumer use. We are not responsible for business losses, including loss of profits, revenue, business opportunities or anticipated savings, arising from consumer purchases.

18. Privacy & Cookies

We process personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is explained in our Cookie Policy, and you can manage non-essential cookies through the cookie preferences available on our website where applicable.

19. Third-Party Links

Our website may contain links to websites operated by third parties.

We are not responsible for the content, availability or practices of third-party websites. Their own terms and privacy policies will apply when you use them.

20. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to our services, business or applicable law.

The Terms that apply to an order will generally be those in effect when the contract for that order was formed.

The latest version will be available on our website.

21. Governing Law & Disputes

These Terms are governed by the laws of England and Wales.

If you live elsewhere in the United Kingdom, you will retain any mandatory consumer protections and rights to bring proceedings in the courts available to you under applicable law.
